SECTION 1 - PRODUCT SAFETY, ASSUMPTION OF RISK & FITNESS EQUIPMENT DISCLAIMER
1.1 Assumption of Risk
By purchasing and using any Fit-Tech product, including but not limited to Power Hooks, lifting straps, belts, sleeves, barbell pads and other fitness accessories, you acknowledge and agree that strength training, resistance exercise and physical activity involve inherent risks, including but not limited to serious injury, permanent disability and death.
You voluntarily assume all risks associated with the purchase, use, misuse or inability to use Fit-Tech products. You acknowledge that no fitness product can eliminate the risks associated with exercise and that the safe use of any product depends upon proper technique, exercise selection, supervision where appropriate, and individual user judgement.
1.2 User Responsibility
Users are solely responsible for ensuring that any Fit-Tech product is suitable for their individual anatomy, hand size, wrist size, body dimensions, strength level, training experience and intended use.
Before each use, users must inspect all products, including straps, hooks, stitching, fasteners and attachment points, for signs of wear, damage or malfunction. If any damage, excessive wear, discomfort or irregularity is observed, use must cease immediately.
Users are responsible for ensuring products are correctly fitted, adjusted and secured before use.
1.3 Power Hooks Specific Warning
Power Hooks create a physical connection between the user and training equipment.
Users must ensure they understand how to safely engage and disengage from the equipment before performing any exercise.
Users should only perform exercises where they can safely release the weight or disengage from the equipment if necessary.
Special caution should be exercised when performing suspended, hanging, bodyweight-supported or other movements where disengagement may be restricted.
Fit-Tech recommends practising the use of Power Hooks with light loads before attempting heavier lifts.
1.4 Prohibited Modifications
Products must not be modified, altered, repaired, reconstructed or used in any manner inconsistent with their intended purpose.
Any modification or misuse immediately voids any warranty and is undertaken entirely at the user's own risk.
1.5 No Medical Advice
Information provided by Fit-Tech, whether on this website, social media channels, product packaging, marketing materials or customer communications, is provided for informational purposes only and does not constitute medical, health, physiotherapy or professional fitness advice.
Users should consult an appropriately qualified professional before beginning any exercise programme or using fitness equipment if they have any concerns regarding their health or physical condition.
SECTION 2 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Fit-Tech shall not be liable for any injury, loss, damage, expense or claim arising from:
• Improper use of a product;
• Failure to follow instructions or warnings;
• Incorrect fitting or adjustment of a product;
• Product misuse or modification;
• Inappropriate exercise selection;
• Failure to inspect products before use;
• Normal risks associated with strength training, resistance exercise or physical activity.
In no event shall Fit-Tech be liable for any indirect, incidental, consequential, special, exemplary or punitive damages arising from the use of its products.
Fit-Tech's maximum aggregate liability for any claim relating to a product shall not exceed the purchase price paid for that product.
Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable consumer protection or product safety laws.
SECTION 3 - WARRANTY
Fit-Tech products may be covered by a separate written warranty where stated.
Any warranty provided applies only to manufacturing defects arising during normal intended use and does not cover damage resulting from misuse, accidents, improper fitting, normal wear and tear, product modifications or failure to follow product instructions.
Warranty claims may require photographs, videos, proof of purchase and return of the product for inspection.
SECTION 4 - GENERAL TERMS
We reserve the right to refuse service to anyone for any reason at any time.
You agree not to use our products for any unlawful purpose or in violation of any applicable local, national or international law.
Any breach of these Terms may result in suspension or termination of service.
SECTION 5 - GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
Nothing in these Terms shall affect any mandatory consumer rights afforded to customers under applicable law in their country of residence.
